1. About these Terms

These Terms & Conditions apply to products, services and programmes offered by Dominique Boesten through dominiqueboesten.nl or directly by Dominique Boesten.

These may include, among other things:

  • in-person and online Qigong and Chinese Exercise classes;
  • workshops, courses and live programmes;
  • the Qi Oasis and other memberships;
  • Qi Development Tools and similar educational programmes;
  • the Qi Reset Library and other digital or on-demand products;
  • videos, recordings, workbooks, practice materials and other digital resources.

By purchasing or registering for a product, service, membership or programme, you agree to these Terms & Conditions.

Any additional terms clearly communicated for a particular programme or offer also form part of the agreement.

Nothing in these Terms limits any mandatory rights you have under applicable consumer law.

PART I — PURCHASES, PAYMENTS & ACCESS

2. Prices and payment

All prices shown to consumers include VAT where VAT is applicable, unless clearly stated otherwise.

The price and payment terms applicable to your purchase will be shown or communicated before you enter into the agreement.

Depending on the product or service, payment may be made through payment methods including Mollie, iDEAL, Bancontact, credit card, PayPal or bank transfer.

For memberships or programmes paid by recurring or agreed instalments, the payment schedule communicated at the time of purchase forms part of the agreement.

You are responsible for providing accurate billing and contact information.

3. Confirmation of your purchase

After an online purchase, you will receive confirmation electronically, normally by email.

Please check that the email address you provide is correct and check your spam or junk folder if you do not receive an expected confirmation or access email.

If you believe a payment has been completed but have not received the expected confirmation or access information, please contact:

do@dominiqueboesten.nl

4. Digital products and access

Digital products may include video practices, recordings, online libraries, downloadable materials, workbooks, links and other digital content.

For products such as the Qi Reset Library, access may be provided automatically after successful payment through an email containing a link to the relevant online content.

Unless explicitly stated otherwise, your purchase grants you a personal, limited, non-exclusive and non-transferable right of access and use.

You may not share your access link, login details, recordings or purchased materials with another person.

Dominique Boesten may change the technical platform used to deliver digital content, provided that this does not materially reduce the content or access you purchased.

PART II — RIGHT OF WITHDRAWAL & CANCELLATION

5. Your statutory right of withdrawal

If you are a consumer purchasing online or otherwise at a distance, you will generally have a statutory 14-day right of withdrawal, unless a legal exception applies.

For services and digital content supplied online, the withdrawal period generally runs for 14 days after the agreement is concluded.

You do not have to provide a reason for exercising this right.

Information about your right of withdrawal and any applicable exception will be provided before you complete your purchase.

You may exercise your right of withdrawal using the online withdrawal function on dominiqueboesten.nl, by emailing do@dominiqueboesten.nl, or by using the statutory model withdrawal form provided to you.

The online withdrawal function is an additional method. You remain free to communicate your decision to withdraw in another clear way permitted by law.

Where a valid withdrawal is made, any refund due will be made within the statutory period and, in principle, using the same payment method used for the original transaction unless another method is expressly agreed.

Dutch consumer guidance confirms that online consumers generally have 14 days to withdraw and that traders must explain this before purchase. Since 2026, an online withdrawal function must also be available for eligible online contracts. AcM

6. Digital content supplied immediately

Some products, including the Qi Reset Library and other on-demand video or digital resources, are designed to be available immediately after purchase.

Where applicable, before completing your purchase you may be asked to:

expressly consent to the supply of the digital content beginning during the statutory withdrawal period; and

acknowledge that, once supply of the digital content has begun in accordance with the applicable legal requirements, you lose your statutory right of withdrawal in relation to that digital content.

Your consent and acknowledgement will be confirmed to you electronically.

Where these legal requirements have not been met, your statutory right of withdrawal is not excluded merely because access information has been sent to you.

This distinction matters: EU rules require prior express consent, acknowledgement of the loss of the withdrawal right and confirmation to the consumer for paid digital content where the trader relies on this exception. EUR-Lex

7. Services beginning during the withdrawal period

For live programmes, memberships, classes or other services that begin during the statutory withdrawal period, you may be asked to expressly request that the service begins before that period has expired.

If you subsequently exercise your statutory right of withdrawal, you may be required to pay a proportionate amount for services already supplied where permitted by law and where the applicable requirements have been met.

If a service has been fully performed during the withdrawal period, the right of withdrawal may be lost only where the applicable legal requirements have been satisfied.

8. Cancellation outside the statutory withdrawal period

Once any applicable statutory withdrawal period has expired or the right of withdrawal has lawfully been lost, cancellation and refund rights depend on the particular product or service purchased.

Unless otherwise stated for a specific offer:

Digital products: purchases are non-refundable once the statutory withdrawal right has lawfully expired or been lost, except where mandatory consumer law provides otherwise.

Fixed-term programmes and courses: registration is for the programme as purchased. Missing a live session does not in itself create a right to a refund where the programme or relevant materials remain available as agreed.

Single classes or workshops: any specific cancellation policy will be communicated when booking.

Nothing in this section affects your rights where a product or service does not conform to what was agreed or where mandatory law gives you another remedy.

PART III — MEMBERSHIPS & PROGRAMMES

9. Memberships

Where you purchase a membership such as the Qi Oasis, the price, billing frequency, content and applicable cancellation arrangements will be communicated before you join.

If a membership runs on a recurring basis, you may cancel it in accordance with the cancellation terms communicated when you joined and with applicable consumer law.

Cancellation stops future membership obligations in accordance with those terms; it does not automatically entitle you to repayment for a period already properly supplied.

Access to membership-only content may end when your paid membership period ends.

Where recordings or other resources are offered as part of a membership, availability may change over time unless lifetime or permanent access was expressly promised.

Applicable Dutch rules require consumers to be informed before purchase about the duration and termination arrangements of subscriptions and service agreements. AcM

10. Live programmes and courses

Programmes may consist of a combination of:

live online sessions;

recorded sessions;

workbooks;

practice videos;

digital resources;

WhatsApp or other community groups;

and other supporting materials.

The exact content, schedule and access period will be described in the relevant offer.

Dominique Boesten may make reasonable changes to lesson content, exercises, order of delivery or supporting materials where this improves delivery or is reasonably necessary, provided the essential nature of the programme is not materially changed.

11. Missed sessions

You are responsible for attending live sessions at the scheduled time.

If you miss a session for personal reasons, no refund is due solely because you were unable to attend.

Where a recording is included in your purchase, you may use that recording subject to the access period and intellectual property provisions in these Terms.

12. Changes or cancellation by Dominique Boesten

Occasionally a class, session or programme may need to be rescheduled due to illness, emergency, technical failure or another circumstance reasonably outside Dominique Boesten’s control.

Where reasonably possible, an alternative date, recording or comparable solution will be offered.

If Dominique Boesten permanently cancels a paid service that has not been provided, you will receive an appropriate refund for the part that has not been supplied, unless another solution is agreed with you.

PART IV — HEALTH, PARTICIPATION & PERSONAL RESPONSIBILITY

13. Nature of Qigong and Chinese Exercise

Qigong, Chinese Exercise, movement practices, breath practices and related educational material offered by Dominique Boesten are intended for general education, movement, relaxation and personal practice.

They are not medical treatment, medical diagnosis, physiotherapy, psychotherapy or personalised medical advice.

No statement made in a class, video, programme, workbook, website, social media post or other material should be interpreted as a diagnosis or as a substitute for advice or treatment from an appropriately qualified healthcare professional.

14. Your health and participation

Participation is voluntary.

You are responsible for deciding whether an exercise or practice is appropriate for you and for practising within your own abilities and physical limits.

Stop an exercise if you experience pain, dizziness, unusual shortness of breath or another concerning symptom.

If you are pregnant, have an injury or medical condition, are recovering from surgery or treatment, or have any doubt about whether a practice is appropriate for you, seek advice from an appropriately qualified healthcare professional where necessary before participating.

You are not required to perform any movement that feels inappropriate for you.

15. No guaranteed outcomes

Qigong and related practices affect individuals differently.

Testimonials, examples and descriptions of possible benefits are illustrative and do not constitute a promise or guarantee of a particular physical, emotional, health, wellbeing or other outcome.

PART V — INTELLECTUAL PROPERTY

16. Ownership and permitted use

Unless otherwise stated, the content provided by Dominique Boesten, including videos, recordings, written materials, website content, graphics, photographs, course structures and original teaching materials, is owned by Dominique Boesten or used with permission from the relevant rights holder.

Some programme materials, methods or educational content may originate from or be licensed by third-party teachers, training organisations or rights holders. Those materials remain subject to their respective intellectual property rights.

Purchasing a programme or product does not transfer ownership of its intellectual property to you.

Your purchase gives you permission to use the material for your own personal practice and learning only, unless you have received express written permission for another use.

17. What you may not do

Without prior written permission, you may not:

copy, reproduce or redistribute purchased materials;

share videos, recordings, access links or workbooks with other people;

upload materials to another website, platform, social media account, membership or file-sharing service;

sell, sublicense or commercially exploit the materials;

record or distribute live sessions;

or present protected teaching materials as your own.

Nothing in these Terms restricts any use that must legally be permitted.

PART VI — LIVE RECORDINGS & COMMUNITIES

18. Recording of online sessions

Some online classes and programme sessions may be recorded for participants.

Where a session is recorded, participants will be informed.

Depending on the format, your name, voice, image or contribution could appear in a recording if your camera or microphone is switched on or if you actively contribute.

Where reasonably possible, you may participate with your camera switched off and may choose not to speak.

Recordings are intended for the purposes communicated to participants. They will not be used publicly for marketing merely because you participated in a class, unless an appropriate separate legal basis or permission applies.

19. WhatsApp and other community groups

Some programmes include an optional or integral community group using WhatsApp or another third-party platform.

If you join such a group, other members may be able to see information associated with your account, such as your name, profile image and telephone number, depending on the platform and your settings.

Participation in a community group means you agree to communicate respectfully and to respect the privacy of other members.

You may not copy, publish or distribute another participant’s personal messages, images, stories or other personal information outside the group without their permission.

Dominique Boesten may remove a participant from a community space in cases of serious or repeated inappropriate behaviour, harassment, misuse of materials or violation of another participant’s privacy.

Use of third-party platforms is also subject to the terms and privacy practices of those platforms.

PART VII — WEBSITE & THIRD-PARTY SERVICES

20. Technical availability

Reasonable efforts are made to keep digital products and online services available and functioning properly.

However, uninterrupted availability cannot be guaranteed. Temporary interruption may occur because of maintenance, hosting problems, internet outages, platform failures or circumstances outside Dominique Boesten’s reasonable control.

Where a technical problem materially prevents access to something you purchased, please contact do@dominiqueboesten.nl so that a reasonable solution can be provided.

21. Third-party services

Products and services may use third-party providers or platforms, including payment providers, email providers, video platforms, communication services and online meeting software.

Their own terms and privacy policies may also apply when you use their services.

More information about the processing of personal data can be found in the Privacy Policy on dominiqueboesten.nl.

PART VIII — LIABILITY

22. Liability

Dominique Boesten is responsible for performing her contractual obligations with reasonable care.

Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.

To the extent permitted by law, Dominique Boesten is not liable for loss or damage resulting from:

use of exercises or materials contrary to instructions;

a participant knowingly exceeding their own physical limits;

incorrect or incomplete information supplied by the participant;

unauthorised sharing or use of access credentials;

or circumstances outside Dominique Boesten’s reasonable control.

Nothing in these Terms removes any mandatory consumer rights or any liability that cannot legally be excluded or limited.

PART IX — PRIVACY

23. Personal data

Personal data is processed in accordance with the Privacy Policy published on dominiqueboesten.nl and applicable data-protection law, including the General Data Protection Regulation (GDPR).

The Privacy Policy explains, among other things, what personal data may be collected, why it is processed, which service providers may receive data, how long information is retained and what rights you have.

PART X — COMPLAINTS & DISPUTES

24. Questions and complaints

If you have a question or complaint about a purchase, programme or service, please contact:

Dominique Boesten
Boermansstraat 23
6001 CG Weert
The Netherlands

Email: do@dominiqueboesten.nl
Telephone: +31 (0)6 54 24 53 36

Please provide enough information to identify your purchase and understand your question or complaint.

Dominique Boesten will endeavour to respond within a reasonable period.

25. Applicable law

These Terms and agreements with Dominique Boesten are governed by Dutch law.

If you are a consumer who habitually resides in another country, this choice of Dutch law does not deprive you of any mandatory consumer protection to which you are entitled under the law that would otherwise apply.

Any dispute will be submitted to the competent court in accordance with applicable law.

PART XI — FINAL PROVISIONS

26. Changes to these Terms

These Terms may be updated from time to time, for example to reflect changes in the services offered, technology or applicable law.

The version applicable to a purchase is generally the version that was in effect when the agreement was entered into, unless a change is required by law or is otherwise validly agreed.

Changes to these Terms will not retrospectively remove statutory or contractual rights already acquired by a consumer.

27. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue to apply to the extent permitted by law.
